Public/Private Partnerships

In 1652, the Water Works Company of Boston was the first private firm in America to provide drinking water to citizens.

When the private sector pursues an opportunity in the public sphere and alternatively when government leaders recognize the need to seek assistance from the private sector, the two groups create a public/private partnership (P3). P3s are often long-term arrangements for services and can prove effective in several areas:

  • Economic Development
  • Education
  • Parks and facilities
  • Public safety
  • Public services
  • Real estate
  • Telecommunications
  • Transportation
  • Water/wastewater

As governments address the growing demand for improved infrastructure, they need to create innovative solutions, which is exactly what Bingham McHale provides. Our attorneys have the knowledge and experience needed for assisting governmental units and private companies on P3 projects.

More than a decade ago, our attorneys helped the City of Indianapolis privatize its wastewater treatment plant. We were involved in the negotiations and the final agreement with White River Environmental Partnership. We also helped submit one of the lead proposals in the historic State of Indiana’s 75-year lease agreement for the Indiana Toll Road.
