Estate Planning

Bingham McHale’s Estate and Wealth Transfer Planning Group is founded on the basic tenets of confidentiality, sensitivity and experience. As our client, you can rest assured that the utmost professional integrity, compassion and skill are taken in the development and execution of your estate plan.

Our attorneys are knowledgeable in estate planning, individual, business and estate tax planning, estate administration, probate, guardianship, health care planning and the use of various trusts including testamentary, living, qualified personal residence, life insurance, grantor retained interest, charitable lead and charitable remainder trusts. In cases of family businesses, we assist in creating agreements for the transfer of ownership and control, while often also providing for the economic benefit of non-participating family members.

We encourage early estate planning in anticipation of future circumstantial changes. We also initiate follow-up proceedings at regular intervals to make necessary changes to existing plans. We devise strategies that address unanticipated situations such as disability, the use of long-term care facilities and death of other family members. Our group continually monitors the ever-changing landscape of income, estate and gift tax laws, as well as Indiana statutes, insurance products and health care options that can affect the execution of your estate plan. Ultimately, our goal is to provide the best, and most current, legal advice possible. We focus on the continued enforceability of estate planning documents and the successful transaction of wealth transfers between generations.

We focus on the continued viability of estate planning documents and the successful transition of wealth transfers between generations.

We handle your estate and financial affairs appropriately, responsively and in a manner that you determine. As a means of efficiently and effectively accomplishing these goals, our perceptive attorneys incorporate the assistance of both attorneys and paralegals. Additionally, we utilize advanced computer technology to provide you with innovative legal services at a reasonable cost.
